Adv. Fatuma Hassan10 December 20246 min read

The Employment Act 2007 and Labour Relations Act 2007 provide strong protections for Kenyan workers. Here is a plain-language summary of your rights.

Kenya's employment laws are governed primarily by the Employment Act, 2007, the Labour Relations Act, 2007, and the Work Injury Benefits Act, 2007.

Key Employee Rights

**Right to a Written Contract**: Every employee must be given a written contract of employment within two months of commencement.

**Leave Entitlements**: You are entitled to 21 working days of annual leave per year after 12 months of service. Maternity leave is 3 months (fully paid), and paternity leave is 2 weeks.

**Notice Periods**: Either party may terminate employment by giving notice as per the contract or as prescribed by the Act (minimum 28 days for employees earning above KES 1,500/month).

**Protection from Unfair Dismissal**: Dismissal without valid reasons or without following due process is unlawful. You may claim compensation at the Employment and Labour Relations Court.

**Minimum Wage**: Kenya has sector-specific minimum wages set by the Labour Commissioner. Check the latest government gazette for your sector's rates.
